If you are a Trade Customer or use our Trade Portal, these Terms must be read together with, and operate in addition to, our Terms of Trade. By accessing, browsing, or using the Site (including purchasing any product), you agree to be bound by these Terms and the Website Policies.

Definitions
In these Terms:
• "Account" means a user account created by You on the Site to facilitate the placing of Orders.
• "Content" refers to all information, text, materials, images, data, links, software, or other material accessible on or through the Site.
• "Gift Card" refers to physical and digital (eGift Card) Roam Gear branded gift cards.
"Order" refers to an offer made by You to purchase Products from us.
• "Policies" means the full suite of policies governing the use of the Site and the purchase of Products, including but not limited to our Privacy Policy, Shipping Policy, Returns Policy, Warranty Policy, and Gift Card Terms & Conditions.
• "Products" refers to any goods or services that are marketed and sold by Roam Gear on the Site.
• "Site" means the Roam Gear website located at https://www.roamgear.com.au and all its subdomains.
• "Trade Customer" means any person or entity, including a sole trader, partnership, company or other business, that holds an approved Trade Account with Roam Gear under the Terms of Trade.
• "Trade Portal" means the secure online service provided exclusively to approved Trade Customers.
• "You" or "Your" refers to the user of the Site, including retail customers, Trade Customers, website visitors, or any individuals accessing our services.

Website And Trade Portal Account Management
To place an Order with Roam Gear, you may create a customer account ("Account") or check out as a guest. By creating an Account, you confirm that you are at least 18 years of age (or are using the Site with the involvement of a parent or guardian) and that all information you provide is accurate and complete. You agree to keep your Account information updated.
Roam Gear Trade Portal Accounts
The Roam Gear Trade Portal ("Trade Portal") is a secure online service provided exclusively to approved Trade Customers who hold a valid commercial account under our Terms of Trade. All access to, and use of the Trade Portal is strictly governed by these Website Terms and Conditions and the Terms of Trade. These specific terms will be presented to the Trade Customer for acceptance prior to their initial login to the portal.
Account Security and Your Liability
You are solely responsible for maintaining the confidentiality of your Account login credentials (username and password). You accept full legal and financial responsibility for all activities that occur under your Account.
You must notify Roam Gear immediately in writing at support@roamgear.com.au if you become aware of or reasonably suspect any unauthorised use of your Account. Until Roam Gear receives such notification, you will be held liable for all transactions and activities conducted through your Account, including any unauthorised Orders.
Account Suspension and Termination
Roam Gear may suspend or terminate an Account, with or without notice, if we reasonably believe you have breached these Terms, any applicable Website Policies, or (if you are a Trade Customer) the Terms of Trade.

Products And Pricing
We make every effort to accurately display the colours, features, specifications, and details of our Products. However, we cannot guarantee that your computer's display of any colour will be accurate. Product images are for illustrative purposes only.
Pricing
All prices are in Australian Dollars (AUD) and set out GST separately where applicable. We reserve the right to change prices for Products at any time without notice.
Errors and Inaccuracies
We strive to provide accurate Product and pricing information, but typographical errors may occur. We reserve the right to correct any errors / inaccuracies and to change or update information at any time without prior notice.
Product Availability
All Products are subject to availability. We reserve the right to discontinue any Product at any time. If a Product is unavailable after you place an Order, we will notify you and offer a refund or alternative Product.
Promotional Offers
Promotional offers (including discount codes) are subject to availability and validity periods. We reserve the right to modify or cancel promotions at any time. Promotions cannot be used in conjunction with other offers unless explicitly stated

Order Process
When you place an Order through the Site, this constitutes an offer by you to purchase Products. All Orders are subject to acceptance by us.
Order Confirmation
We will confirm acceptance of your Order by sending you an Order confirmation email. The contract between you and us will only be formed when we send you this confirmation. Confirmation emails will be sent only from the official Roam Gear domain (@roamgear.com.au).
Order Verification
We reserve the right to verify Orders and payment details before processing. We may contact you to confirm details.
Order Modification or Cancellation
We may, at our sole discretion, accept a request for the modification or cancellation of an Order. A request for the modification or cancellation of an Order may be submitted through our online Support Portal.
Once an Order has been processed for dispatch, it cannot be cancelled. If your order cannot be cancelled, the order must be treated as a return in accordance with our Returns Policy.
Order returns, cancellations and modifications may be subject to a restocking fee, as advised by us to you at the time you make the relevant request

Payment Processing
All transactions are processed through secure payment gateways. Your payment details are encrypted and secure. We do not store your full credit card details on our servers.
Authorisation Holds
When you place an Order, we may request a pre-authorisation of your credit card to verify sufficient funds, but you will only be charged when your Order is shipped.
Declined Payments
If your payment is declined, your Order will not be processed. We will notify you by email, and in certain cases, you may provide an alternative payment method. Emails will be sent only from the official Roam Gear domain (@roamgear.com.au).
Suspect Fraud
We reserve the right to cancel or refuse to process any Order if we reasonably suspect it to be fraudulent, in breach of these Terms, or otherwise in violation of the law. If we cancel an Order on this basis, we will attempt to notify you and will issue a full refund to the original payment method.

Delivery And Click & Collect
We offer various delivery options, including Standard Delivery, Express Delivery, and Click & Collect. All available options to you will be displayed during checkout. Please refer to our Shipping Policy for detailed information about collection and delivery options, times and fees.
Title
Legal title to the Products passes to you only upon our receipt of payment in full for the Order.

Returns And Refunds

All other warranties or conditions which are not guaranteed by the Australian Consumer Law are expressly excluded where permitted, except to the extent such warranties and conditions are fully expressed in these Terms. To the extent permitted by law, Roam Gear’s liability for any breach of a consumer guarantee is limited to the remedies available under the ACL.

Roam Gear has a branding kit available to Affiliates, Influencers and Trade Customers. This kit comes with guidelines on when and how it can be used and by whom.

You may use the Site only for lawful purposes and in accordance with these Terms. You agree to use the Site in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site.

• Violate any laws, regulations, or third-party rights
• Transmit harmful, illegal, or defamatory materials
• Interfere with the proper functioning of the Site

Force Majeure
Neither party will be liable for any delay or failure to perform its obligations under these Terms (other than an obligation to pay money) if such delay or failure results from circumstances beyond its reasonable control. These circumstances include, but are not limited to acts of God, natural disasters, pandemics or epidemics; war, terrorism, civil unrest, or government action; strikes or labour disputes; cyber-attacks, internet service provider failures, or delays involving third-party logistics or courier providers.

Limitation Of Liability
Subject to your rights under Australian Consumer Law, to the maximum extent permitted by law:
• Roam Gear and its directors, officers, employees, and agents exclude all liability for any indirect loss or damage of any kind (including consequential loss, special loss, loss of profit, or loss of opportunity) whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise, arising from or connected to the Site or the Products;
• A party’s liability under these Terms will be reduced proportionately to the extent caused or contributed to by the acts or omissions of the other party, including any failure by that party to mitigate its loss; and
• Our maximum liability to you will be limited to the amount paid by you for the Product giving rise to the liability, or at our option, the supply of the Product again or the cost of having the Product supplied again.

Governing Law and Dispute Resolution
These Terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland.
Dispute Resolution
In the event a dispute arises between the parties, both parties agree to first seek a resolution through informal negotiation. If the dispute cannot be resolved informally within 30 days, either party may refer the dispute to mediation before commencing formal legal proceedings, except where urgent interlocutory relief is required.

Severability
